What the Supreme Court’s Chevron reversal could mean for PFAS and labor regulations

The U.S. Supreme Court’s decision to reverse the “Chevron doctrine” has raised questions about how the move could affect federal statutes relevant to the waste and recycling industry, particularly those under the U.S. EPA and Department of Labor.  The Chevron doctrine,  decided in a 1984 U.S. Supreme Court decision, Chevron U.S.A. v. Natural Resources Defense Council, determined that in cases where a federal statute is ambiguous, courts should defer to agency interpretations of such statutes as long as it’s a “reasonable” interpretation.  In June, the Supreme Court voted 6-3 in Loper Bright Enterprises v. Raimondo to overturn the Chevron doctrine,…

Starbucks piloting compostable cold cups in select California and Minnesota locations

Finland-based packaging company Huhtamaki is helping Starbucks launch new fiber-based, compostable cups for cold beverages in select locations.  The compostable cups and lids initially will roll out in 24 stores, based on local mandates, and more markets are likely to be added in the future, a Starbucks spokesperson said via email. Starbucks confirmed that Huhtamaki is a partner on this project. Huhtamaki, which has more than a dozen U.S. locations, declined to comment on specific customer partnerships. Both the fiber-based lids and cups will be opaque, said the Starbucks spokesperson. The cup is manufactured from double-walled paperboard with a bioplastic liner,…

GFL will not go private, plans auction for environmental services after Labor Day

All financial information from GFL is in Canadian dollars. GFL Environmental expects to run an auction for its environmental services business sometime after Labor Day, CEO and founder Patrick Dovigi said on the company’s earnings call Thursday. The announcement marks a narrowing of paths forward for the company as rumors of a sale have emerged in recent weeks. Dovigi shut down speculation that GFL would entertain a deal for the whole company, citing conversations with GFL’s board to reach this decision. He said he was motivated in part by GFL’s current stock price, which he believes is trading below the company’s actual…

ReMA urges federal court to review EPA’s PFAS hazardous substance designation

Dive Brief: The Recycled Materials Association has filed a petition asking a federal court to review the U.S. EPA’s designation of certain per- and polyfluoroalkyl substances as hazardous under the Comprehensive Environmental Response, Compensation and Liability Act. ReMA says the designation has the potential to “significantly undermine the use of recycled materials” and create notable liabilities for recyclers “even though the industry does not intentionally purchase, generate, transport, or use PFOA or PFOS in its recycling processes.” The association submitted the filing on July 30 in the U.S. Court of Appeals for the D.C. Circuit. It follows similar petitions from other…
